Tanzania Labour Law (Sheria ya Kazi Tanzania)

Hapa swali lako limekaa kimtego kidogo. Lakini kama nimekuelewa vizuri, unazungumzia makosa ya payroll tu. Na sio kwamba mwajiri amekupa kabisa barua ya increment then anataka kushusha mshahara after two months. Kama ni overpayments due to payroll errors, mwajiri anaruhusiwa kukukata hiyo overpaid amount provided that the total deductions does not exceed one quarter of your salary.
Section 28(5) of the ELRA 2004 states that; An employer shall not require or permit an employee to (a) repay any remuneration except for overpayments previously made by the employer resulting from an error in calculating the employee's remuneration.
So, deductions zinaruhusiwa kisheria kama kweli kuna kosa la overpayments.

Kama amekupa barua ya increment ya mshahara, then anataka kukushusha kwamba alifanya makosa sheria inasemaje!
 
je? muajiri anapovunja mkataba wa zamani na kukupa mpya unaoonesha ongezeko la mshahara kwa madhumuni ya kuhamisha kitengo kimoja kwenda kingine kisha ukakaa mwezi mzima bila kufanya kazi kitengo hicho kipya atatakiwa kukulipa mshara wa mkataba mpya au wa zamani msaada tafadhali.

Why would only Acting Allowance be a taxable income?
What about other allowances? are there any regulations on this?
Please assist.
 
wandugu, msihangaike kutafuta sheria. sheria zote za tz kuanzia mpya hadi za zamani, zipo kwenye website ya parliament of tz. nenda kule utaipata kwenye pdf. nashangaa wengine wanasema walikuwa wanatafuta sheria hizi, wakati ziko wazi sana, tena mno.

Kule kwenye website ya Bunge unapata Pricipla Act lakini hupati Subsidiary zake yaani Regulations zake.

Calculate the difference bwteen your salary and the salary of your superior acting post. Msingi mkuu ni katiba yetu isemayo {Every person is entitled to just remuneration (Katiba ya Tanzania, section. 23)}.

Hivyo, unapo-act unakuwa unafanya kazi ya post ya juu na hivyo mapato unatakiwa upate kama yake maana unafanya uzalishaji kama wake.

Hili suala la manyanyaso katika maeneo ya kazi ni kilio cha sehemu nyingi sana za kazi hapa nchini Tanzania. Kuanzia katika kampuni na mashirika yanayoongozwa na kumilikiwa na wazawa mpaka yale yanayoendeshwa na wawekezaji toka nje. Kwa kiasi kikubwa mimi naamini ya kwamba hii yote ni kutokana na uzembe wetu sisi kama wafanyakazi kutotaka kuzifuatilia na kuzifahamu sheria zetu na kuhakikisha zinatekelezwa katika maeneo yetu ya kazi.

Hivi ni section gani inazungumzia malipo baada ya mkataba kuisha? Sec 42 ya ELRC 2004 inasema severance pay ni hadi uwe terminated sasa mimi mkataba umeisha na sikuwa terminated, natambua section 42.1 inasema malipo yapo ila section 42 iko chini ya heading "other incidents of termination" naomba msaada jamank
 
Severance pay ni haki anayoipata mfanyakazi mara tu ajira inapokoma. Sifa ya kupata hiyo severance pay ni mpaka uwe umefanya kazi kwa muda wa mwaka au zaidi, na unalipwa si zaidi ya miaka kumi ktk utumishi wako. Kwa mshahala wa siku 7 kwa kila mwaka.

Kuna marekebisho yalifanyika. Kama uko pensionable, severance hailipwi
