Habari zenu wadau,

Hivi hawa mapersonal/hr officer/manager wanazijua? Kwanini unyanyasaji makazini bado unaendelea, kwa mfano unamkuta manager (branch manager) anaongoza wafanyakazi 3-10, anawaongoza just he/she has experience na kazi lkn hajui sheria za kazi wala mambo ya utawala.

Naomba kwa wale wanaoongozwa na brach manager watupe changamoto wanazokabiliana nazo ili tujue tunafanyaje kukomesha tabia hii.
 
ninamaanisha hivi....km ww umeajiriwa na org yoyote hp tz lkn uko chini ya usimamizi wa branch manager nataka kujua changamoto unazokumbana nazo, most of the time branch office huwa haina wafanyakazi wengi sasa labda ule uchache wa wafanyakazi sijui ndio kitu ambacho kinawafanya hawa managers kutokufuata hizi sheria za kazi ama vp, mikataba mibovu, mazingira ya kufanyia kazi mabovu, mishahara mibovu almost everything is mess.
 
Mkuu hoja yako inatukuna wengi sana. Ni vyema pia ukaruhusu tuweke hata haya makampuni ya nje ambayo yemetuma wawakilishi wao tu kuja kutuongoza kwa sheria wanazozijua wenyewe.

Kwa mfano kuna kampuni moja ya wakenya wako watatu yaanai General Manager ambaye pia anajulikana kama country director, chief accountant pia kama CFO na store keeper anajulikana kama Merchandising Manageer. Sasa hawa jamaa huwa hawajishughulishi kabisa na haki za mfanyakazi kwa namna yoyote ile.

Juzijuzi hapa kuna mfanyakazi kafiwa na baba yake mzazi lakini hakuna chochote walichofanya ikiwemo hata kumsaidia nauli au gharama za mazishi au pole ya aina yoyote. Kilichofanyika walituamuru tukae kimya kwa dakika moja ndani ya mkutano kisha yakaisha hivyo.

Katika mkataba inaonyesha mtu anatakiwa alipwe mshahara na commission kutokana na mauzo yake. Mwezi huu hakuna commission iliyolipwa kisa tu wamemleta CFO mpya ambaye kila akiulizwa anadai hana muda wa kuzungumza na wafanyakazi. Sasa sijui haki hizi tutadai vipi maana wengine ni wepesi wa kurusha ngumi kutokana na style ya uendeshaji wa hawa jamaa.

Tafadhali tushaurini nini cha kufanya maana ubaguzi ni mkubwa sana kati ya watanzania na wakenya na hali ya kudharauriana ni kubwa sana hapa.
 
Hili suala la manyanyaso katika maeneo ya kazi ni kilio cha sehemu nyingi sana za kazi hapa nchini Tanzania. Kuanzia katika kampuni na mashirika yanayoongozwa na kumilikiwa na wazawa mpaka yale yanayoendeshwa na wawekezaji toka nje. Kwa kiasi kikubwa mimi naamini ya kwamba hii yote ni kutokana na uzembe wetu sisi kama wafanyakazi kutotaka kuzifuatilia na kuzifahamu sheria zetu na kuhakikisha zinatekelezwa katika maeneo yetu ya kazi.

Kwa nini nasema hivi? Nna mfano mmoja wa kampuni ya Watanzania wenye asili ya Kiasia ambao wao wakati wa kufanya usaili ili kuweza kukuajiri mnapofika kujadili mshahara na marupurupu wanakuambia kwamba watakulipa mshahara mkubwa, kwa mfano TZS 1,000,000.00 baada ya kodi na makato lakini katika vitabu vya mahesabu na slip yako itaonekana umelipwa TZS 500,000.00. Hii ni moja ya mbinu zao za kukwepa kodi. Sasa unapoanza ajira kwa kukubaliana na mambo kama haya ilhali unajua sheria za nchi na sheria za kazi zinasemaje nadhani moja kwa moja tunakuwa tunaweka mianya ya unyanyasaji na uvunjifu wa sheria za kazi katika maeneo ya kazi.

L'amour umeongelea kuhusu mfanyakazi kufiwa na jambo ambalo hao Wakenya kitu walichofanya. Watu wanatakiwa kufahamu kwamba sheria ya kazi inaweka mwongozo wa nini Mwajiri anategemewa kumfanyia mwajiri wake na pia inabainisha nini majukumu ya Mwajiriwa kwa mwajiri. Lakini pia katika kila kampuni au shirika kuna Kanuni na Taratibu ambazo zinawekwa kutokana na sheria za kazi ambazo zinatumika katika nchi husika. Katika sheria ya kazi unapofiwa na Mzazi, Mke, Mtoto wako una haki ya kupata "Compassionate Leave" siku 4 yenye malipo. Sasa unakuta kwa makampuni mbali mbali katika kanuni na taratibu zao ndio wanakuwa wanajihusisha na hayo mazishi kwa namna moja ama nyengine. Kuna wale ambao wanakuwa wanakata bima za mazishi kwa ajili ya wafanyakazi wao na immediate family, wengine wana mifuko maalum kwa ajili ya kushughulikia mazishi na kuna waajiri ambao wanatoa pesa kwa mfiwa.

Tunapojadili sheria za ajira na mahusiano kazini tunatakiwa kuangalia na tutofautishe na kanuni na taratibu katika maeneo yetu ya kazi husika kwani haziwezi kuwa zinafanana katika mashirikika tofauti.
 
Nakubaliana na wewe LUSAJO L.M unajua hizi shida zetu ndio zinatufanya tujisahau na kuona kuwa kuajiriwa ni favour na sio constitutional right. Wanatumia ujanja wa divide and rule na utakuta kila unapotaka kuwaunganisha watu wanafiki wachache wanavuruga. Mfano mmoja ni pale mtu na familia yake amepewa laki mbili za uhamisho kutoka Arusha hadi Dar.

Nadhani hii ni kinyume cha sheria ya kazi inayotaka kuwepo na majadiliano ya pande zote mbili nadhani mnaita negotiation shop lakini hawa jamaa hawajali hicho kitu. Ujanja wanaoutumia ni kukutengenezea mazingira magumu ya kazi na kukufanya uache mwenyewe. Sijui tutapata wapi mtu wa kutuokoa na hawa watu wa private sector maana hata serikali yetu inayajua na inayaangalia tu.

Tanzania tuna hitaji kubwa sana la maarifa ya sheria. Tatizo ni kwamba, watz wengi hatupendi kusoma. Pamoja na kuwa waajiriwa wana haki ya kpata nakala ya sheria hii na wananyimwa na waafiri wao, wao wenyewe hawana juhudi ya kuitafuta.

Na hili sio tu kwa upande wa sheria bali ni kwa kila kitu. Watanzania wengi hatupendi kusoma, huo ndio ugonjwa mkubwa tulionao. Nachelea kuwa hata waajiri wakigawa hizi nakala wengi hawatasoma.

I am a general manager in a company and have been since february 2010. My employer decided (without discussing it with me) in the meantime to make me do another job as a 'meet and greet' due to lack of employees. With this he has also decided not to pay half of the income I receive as a GM, saying i dont do my job well. Emplyer-Employee conflict.

What are my rights and does he have the right to make such descisions without any discussions?

(A) If you are employed as GM to do another job out of what you have employed for this is b'coz of Employers
's interest.
(B) To demand a half-pay of the income as a GM simply b'coz of other duties is b'coz of GM/employee's interest.
IN SO DOING DISPUTE OF INTEREST IS EXISTING THERE IN.

WHAT TO DO:
Mr GM make sure you have a copy of your employment contract in your hands obviously Job discription will be well analysed through that contract. GM is a big title in any Organization, as per contract employment there must be specific task either expresely or implied for GM.

Turning to your concern: you didn't mention specifically which job you have instructed to do and which is not analysed in your contract of employment/job discription. P'se be specific Your right is there come again.
 
Learned bro and sisters, naombeni msaada wenu. Kwa mujibu wa sheria za kazi, mwajiri anaweza kuongeza muda wa kufanya kazi mwajiriwa wake? MATHALANI, muda wa kutoka kazini kwa kawaida ni saa tisa na nusu mchana, je mwajiri anauwezo wa kuamua kuwa watumishi wawe wanatoka saa kumi na moja?
Ndio anaruhusiwa lakini with payment kama extra duty allowances na kwa serikalini extra duty haitakiwi kuzidi siku 10 kwa mwezi na @day ni 30000/= kwa Afisa.

Wana jf nisaidieni, hivi mtu aliyefanya kazi kwa muda wa miaka mitano mfululizo bila kuwa na mkataba wa maandishi na aliyempa kazi anaweza akaitwa mfanyakazi mwenye ajira rasmi? pia mtu huyu amekuwa akipokea mshahara kwa mwezi. vipi haki zake za likizo ambazo hajachukua kwa muda wote ambaoamekuwa akifanya kazi, je anaweza kudai stahili za likizo ambazo hakuomba.
 
Naomba msaada wana jamii. Ndugu yangu alikuwa meneja kwenye kampuni moja kubwa ya makaburu. akasimamishwa kazi bila kuambiwa aandike maelezo juu ya "Pending Investigation" palikuwa na external investigators ambao hawakusema wana investigate kitu gani wala wanatokea wapi mpaka sasa ni mwezi mmoja na wiki kadhaa.

Je sheria inasemaje kwani mtu huyu hajui kosa lake na yuko on suspension muda mrefu. Nimemshauri wa kiterminate contract yake aishtaki ile kampuni na adai fidia ya kufa mtu. wadau mnasemaje maana hawa makaburu wakishaona kampuni inaenda vizuri wanakutoa mbongo na kumleta mkaburu asiye hata na degree ili mradi ni expert.
 
Duh kuna matatizo mengi ya sheria za kazi,post zote matatizo tuuu! Wanasheria hebu njooni huku muokoe jahazi.consultancy fees zipo jamani! Mwe!

ubaya ni kwamba waajiri wengi nao sheria hawazijui na wanaozijua wanazipindisha kwa maslahi yao binafsi.

Natanguliza shukrani zangu za dhati kwa waTz wazalendo mnaoipenda nchi yenu kwa kuwasaidia waTz ili wapate haki zao na pia waweze kufanya kazi katika mazingira mazuri na kwa kufuata sheria na taratibu.

Naomba msaada wenu;
Kuna non-Tz residents (actually makaburu) wanafanya kazi katika kampuni fulani (ni waajiriwa kama wabongo walivyoajiriwa kwenye kampuni hiyo); wanataka walete medical equipments toka Republic of South Africa lkn kuna medical equipments {both needing to be registered (requirement 1.6.2) and not needing registration (requirement 1.6.1), kulingana na guideline ya TFDA kwa namna nilivyosoma katika attachment hiyo hapo chini}.
Vile ambavyo si lazima viwe registered vinahitaji TFDA iwe notified (Article 1.6.1 4th paragraph), lkn hawa jamaa wamekurupuka na kusema wanataka walete vifaa hivyo.
Na kwa namna ninavyoona, kama mtu anataka kuleta medical equipments toka nje inabidi afuate requirement 1.1 & 1.2
Naomba ushauri wenu na mnirushie vifungu na policies/guidelines kadhaa!

NOTE:Hii guideline siioni tena kwenye website yenu ya TFDA

Ndani ya wiki chache zijazo vifaa vitaletwa (mnanishauri nifanyeje ili hata kama vinakuja tuwe tumefuata regulations/ guidelines) - vinginevyo itakula kwangu watu wa Wizarani na / au TFDA wakigundua tunaingiza vifaa bila utaratibu, kwa kuwa mimi nd'o niko answerable katika medical-related issues hapa.
Kuna Paramedics nd’o wanakurupuka na kutaka kuleta vitu bila utaratibu.
Hii itasaidia kuleta discipline na baadaye tunaweza kuwa tunaagiza humu nchini au hata kama ni nje watakuwa wanafuata utaratibu!

Pili:
Hiyo Guideline nimeona inahusu kama;
(a)Mtu anataka alete med. equipments ili afanye biashara, na mtu kama anataka kuleta med.equipments toka nchi zingine ili azitumie, anafanyaje?
(b)Kampuni inataka ilete med. equipments ili ifanye biashara, na kampuni kama inataka kuleta med.equipments toka nchi zingine ili izitumie, inafanyaje?
Au haijalishi kama ni kwa ajili ya biashara au matumizi?

Tatu:
Used medical equipments zinaruhusiwa kuingizwa nchini?
Na kama zinaruhusiwa kuna procedure yoyote ya kufuata?
Kama ipo ikoje,

(a)Kwa:
(i)Mtu anayetaka atumie kifaa/ vifaa hivyo used?
(ii)Kwa kampuni ambayo inataka itumie kifaa/ vifaa hivyo used?

(b)Kama hivyo vifaa vinataka vitolewe na mtu/ kampuni kama donation/ msaada kwa hospitali za serikali.
