You can not claim ownership without evidence and notably documentary evidence be it sale agreement or otherwise!

Issue is mamlaka za ardhi zinapima eneo lako an kuli designate kuwa ni open space (OS), market, cemetery, Public building etc etc etc without consultation with you/kuipa fidia, sheria inasemaje? any case law to that scenario?

Mimi nimekuelewa Sana, unajua scenario yako watu humu wanataka ueleze as if upo mahakamani. Labda kwa maelezo yako nimekuelewa kama ifuatavyo:-
1: eneo lako umenunua kihalali na sale agreement ipo witnessed by local authorities of that disputed piece of land.
2: kuna ramani ipo hapo kwa ajili ya kubadilisha mipango miji ya eneo katika eneo lako wakati wewe ndo real owner of that disputed piece of land.

Unachohitaji hapo ni nini?
1: legal opinion over such disputed piece of land.
2: case law if any.

Legal opinion
1: kwanza nenda kwa wahusika na ufanye research ujue maana no research,no right to speak. Ujue weakness yao iko wapi
2: then unaweza fanya yafuatayo:-

1: write a demand letter giving them 7 days waweze kutoa maelezo ya kina kwa nini wanaingilia eneo lako na bila kukushirikisha and and intention to sue.
2: ikifika siku saba no response, nenda mahakama kuu fungua shauri under MAREVA INJUNCTION.
3: Andaa notice of intention to sue the government (local government) ya siku 90

Case law, zipo nyingi pamoja na hyo case ya MAREVA, ila Case law haikusaidii Sana zaidi ya kutumia JUDICATURE AND APPLICATION OF LAWS ACT ambayo ina recognises the application of general application of laws of 1920 ambazo still ni applicable nchini Tanzania.
