The Richmond Development Company, RDEVCO, was created to bring this dream to life.

Dr. Mohamed Huque had spent most of his considerable academic career studying and working in major institutions in Europe and North America until he left to pursue a career in the private sector. The challenges of international finance and the complex questions they posed drove him to senior executive positions for Marathon Oil, Westinghouse and Duquesne. His intellect and skill helped steer the direction of large scale oil and gas operations, cutting edge research facilities and major utility and electricity providers.
Gire, who grew up in Africa, recognized the potential for transforming communities around efficient power generation. With Dr. Huque's expertise in infrastructure development and Gire's understanding of emerging markets and access to capital, the business model of RDEVCO began to take shape.

Their mutual friendship and complimentary skill sets allowed the two to successfully launch RDEVCO - a company dedicated to building a brighter tomorrow in the developing world.

Mohamed Gire is an active private investor in emerging high-tech companies as well as the offshore real estate and infrastructure sectors.

Mr. Gire brings a unique blend of talent and over 20 years of business insight to growing companies. In 1985, he started the Richmond Printing Company, now one of the largest printing businesses in Texas. This experience fostered his interest in advanced technologies. With his savvy talent for real estate and management, he ventured into other areas. Gire's focus on energy and infrastructure projects has continued since 2003 when he co-founded RDEVCO, LLC. Under Mr. Gire's leadership, RDEVCO has taken its place as a premiere firm specializing in infrastructure development and energy markets.

Mr. Gire has participated in numerous international trade delegations in Africa, Asia and the Middle East. Lewis Lucke (Director of Government Relations)

Lewis Lucke served as the United States Ambassador to the Kingdom of Swaziland from 2004-2006. Before formally accepting his ambassadorship, Mr. Lucke courageously directed the United States Agency for Economic Development's efforts in Iraq. He oversaw the administration of the largest rebuilding, infrastructure and development operation since the Marshall Plan with a budget of over $4.0 billion. The depth and breadth of his 26 years as a mission director in countries across the Middle East, Afrtica and South America speak for themselves. For his outstanding service Ambassador Lucke has received the Administrator's Distinguished Career Award in 2001, and the Agency's award for Heroism in 2004, the highest honors given by USAID. He has also been presented the Award for Exceptional Public Service in 2004 by the Secretary of Defense.
Now living in Austin, Texas Ambassador Lucke is originally from North Carolina. He and his wife Joy have three grown children. Mr. Lucke graduated from the University of North Carolina-Chapel Hill and has an MBA from the Thunderbird School of Global Management in Arizona.
Ambassador Lucke served in the U.S. Foreign Service from 1978-2006. He directed agency missions in ten countries including: Mali, Senegal, Costa Rica, Tunisia, Bolivia, Jordan, Haiti, Brazil, Iraq and Swaziland. Vice President Finance Zahoor Gire, over the past fourteen years has served as Richmond Printings Vice President of Finance & Administration. Zahoor has strong marketing experience in print products and services. Naeem Adam Gire, the person identified as the owner of Richmond Development Company in Tanzania, which was linked to a power generation scandal last year appeared in court yesterday to answer charges of forgery and giving false information.

Gire was charged in the Kisutu Resident Magistrate`s Court with among other counts, giving false information that Richmond Development Company of Tanzania was capable of producing 100MW of electricity.

The accused appeared before Resident Magistrate, Warilwanda Lema.

State Attorney Stanlaus Boniface alleged in court that on March 13, 2006, in Dar es Salaam, with intent to defraud, the accused forged power of attorney dated 13 March 2006 showing that Mohamed Gire, Chairman of Richmond Development Company LLC Texas America had assigned the said powers authorising Naeem Adam Gire of Dar es Salaam to carry on the business of Richmond Development Company LLC in Tanzania. :angry::angry:?????

In the second count it was alleged that on March 20, 2006 at Umeme Park Ubungo area in Dar es Salaam, he uttered the forged power of attorney showing that he had been assigned to carry on the business of Richmond Development Company in Tanzania.

In the third and fourth count it was alleged that on the same date and place he gave false information to members of the Tanesco Tender Board and Government who are employed in public service that Richmond Development Company LLC of Texas, United States was capable of producing 100MW of electricity in Tanzania.
It was alleged that he intended to entice the said members to recommend his company for selection.

In the last count it was alleged that on June 6, 2006, in Dar es Salaam, Naeem Adam Gire uttered the forged power of attorney showing that the chairman of Richmond in Texas, America had assigned a power of attorney authorising him to carry business of Richmond Development Company in Tanzania.

The accused pleaded not guilty to the charges and the prosecution claimed that investigations were not yet completed. The accused through his lawyer then asked the court to grant him bail.

Adam Gire’s lawyer claimed that he had been cooperative during the course of investigations.

He also told the court that the health condition of the accused was not stable and he had been looking for travel documents for treatment outside the country.

The lawyer also claimed that they had title deeds which were in the hands of the police. The court adjourned the case until today for bail consideration.

Findings of the parliamentary select committee on the Richmond scam formed last year to investigate circumstances which led the government to enter into a power generating contract with Richmond Development Company LLC in 2006, implicated former Premier Edward Lowassa, as one of the architects of the controversial deal forcing him to resign along with two other cabinet ministers.





President Jakaya Kikwete was forced to dissolve the cabinet and appoint a new one.

TAARIFA YA WAZIRI MKUU, MHE. MIZENGO P. PINDA, (MB.), KUHUSU UTEKELEZAJI WA MAAZIMIO YA BUNGE YA MKATABA BAINA YA TANESCO NA RICHMOND DEVELOPMENT COMPANY LLC

– 28 AGOSTI 2008
UTANGULIZI:

1. Mheshimiwa Spika, kwa mujibu wa kifungu cha 37(1) cha Kanuni za Kudumu za Bunge (Toleo la 2007), naomba kuwasilisha Taarifa ya Serikali kuhusu Utekelezaji wa Maazimio ya Bunge ya Mkataba baina ya TANESCO na Kampuni ya Richmond Development Company LLC.


2. Mheshimiwa Spika, Katika Mkutano wa Kumi wa Bunge tarehe 15 Februari 2008, Bunge lako Tukufu lilipitisha Maazimio 23 baada ya mjadala wa Taarifa ya Kamati Teule ya Bunge iliyoundwa mwezi Novemba 2007 ili kuchunguza mchakato wa Zabuni ulioipa ushindi Kampuni ya Richmond Development Company LLC wa kuzalisha umeme wa dharura Nchini mwaka 2006. Kwa kuzingatia uzito wa suala hili, wakati nilipotoa Hotuba yangu ya kuahirisha Mkutano wa Kumi wa Bunge nilieleza kuwa Serikali itaunda Timu ndogo ya Wataalam ili kuchambua kwa makini na kupendekeza namna ya kutekeleza Maazimio hayo 23 yaliyopitishwa na Bunge. Vilevile, niliahidi kuwa Kamati hiyo itazingatia mambo yote muhimu yaliyomo kwenye Taarifa ya Kamati Teule ya Bunge na Taarifa za majadiliano zilizoingizwa kwenye kumbukumbu za Bunge (HANSARD).

3. Mheshimiwa Spika, tarehe 25 Aprili 2008 wakati nikitoa Hotuba yangu ya kuahirisha Mkutano wa Kumi na moja wa Bunge lako Tukufu, niliwasilisha Taarifa ya Awali ya hatua zilizochukuliwa na Serikali katika utekelezaji wa Maazimio hayo.

Aidha, niliahidi pia kuwa Serikali itajitahidi kuharakisha utekelezaji wa Maazimio hayo kwa kadri itakavyowezekana na Taarifa rasmi itawasilishwa katika Mkutano huu wa Kumi na Mbili wa Bunge, jambo ambalo linafanyika leo.


4. Mheshimiwa Spika, mwezi Februari 2008 Mheshimiwa Jakaya Mrisho Kikwete, Rais wa Jamhuri ya Muungano wa Tanzania, alikubali kujiuzulu kwa aliyekuwa Waziri Mkuu Mheshimiwa Edward Lowassa (Mb.). Aidha, Mawaziri wawili, Mheshimiwa Dkt. Ibrahim Msabaha, (Mb.), na Mheshimiwa Nazir Karamagi (Mb.), nao kwa wakati mmoja walijiuzulu kwa kuwajibika kwao kisiasa kwa Maslahi ya Taifa. Kutokana na uamuzi wa aliyekuwa Waziri Mkuu kujiuzulu, Kikatiba kulisababisha Baraza zima la Mawaziri kuvunjwa, jambo ambalo lilikuwa ni uamuzi mkubwa kwa Serikali. Hatua hii inaonyesha kiwango kikubwa cha usikivu wa Serikali yetu. Hasa kwa kuzingatia kwamba, hatua hii ilichukuliwa mapema mara tu baada ya Taarifa ya Kamati Teule kuwasilishwa katika Bunge lako Tukufu.

5. Mheshimiwa Spika, pamoja na hatua hiyo, napenda kueleza hatua nyingine muhimu zilizochukuliwa na Serikali hadi hivi sasa:-

Kwanza, Serikali imekwishapeleka maelekezo kwa kila Wizara na Taasisi zinazohusika na utekelezaji wa Maazimio haya na hatua za utekelezaji zinaendelea kuchukuliwa na Vyombo hivyo;

Pili, Kufuatia utata uliojitokeza kuhusu uhalali wa Mkataba baina ya TANESCO na Richmond Development Company LLC uliorithiwa na Dowans S.A, Serikali imechukua hatua ya kusitisha Mkataba huo kuanzia tarehe 1 Agosti 2008.

Tatu, Serikali imesitisha malipo yote ya fedha zinazohusiana na Mkataba baina ya TANESCO na Richmond Development Company LLC uliorithiwa na Kampuni ya Dowans S.A.;

Nne, Watumishi wote wa Umma waliohusika katika mchakato wa kuandaa na kutoa Zabuni ya Mkataba baina ya TANESCO na RICHMOND wameandikiwa barua za kujieleza kama hatua za awali za Kinidhamu kwa kuzingatia Sheria, Taratibu na Kanuni za Utumishi wa Umma. Aidha, kwa wale watakaoonekana kuwa wamefanya makosa ya jinai, hatua stahiki za Kisheria zitachukuliwa dhidi yao.

6. Mheshimiwa Spika, baada ya utangulizi huo sasa ningependa kueleza kipengele kwa kipengele kuhusu hatua za utekelezaji wa Maazimio yote kama yalivyorekebishwa tarehe 15 Februari 2008 na Mtoa Hoja wakati akihitimisha hoja yake.

Sheria ipitiwe upya ili kuiboresha kwa kuipa Mamlaka ya Udhibiti wa Ununuzi wa Umma (PPRA) nguvu zaidi za udhibiti na uwezo wa kuchukua hatua pale Sheria na Kanuni zinapokiukwa, badala ya kutoa ushauri tu kama ilivyo sasa.”

HATUA ZILIZOCHUKULIWA:

Wizara ya Fedha na Uchumi ikishirikiana na Ofisi ya Mwanasheria Mkuu wa Serikali pamoja na Mamlaka ya Udhibiti wa Manunuzi ya Umma (PPRA), wamekwishaainisha maeneo yote yenye mapungufu na yanayohitaji marekebisho kwenye Sheria ya Manunuzi ya Umma ya mwaka 2004.


Baada ya zoezi hilo kufanyika, Serikali itawasilisha katika Mkutano wa Kumi na Tatu wa Bunge lako Tukufu, Mapendekezo ya kufanya Marekebisho katika Sheria hiyo. Maeneo yatakayozingatiwa ni yafuatayo:

(i) Kuipa uwezo PPRA kusitisha Zabuni yoyote pale itakapobainika kuwepo kwa ukiukwaji wa Sheria na Kanuni zinazosimamia Manunuzi ya Umma.

(ii) Kuipa nguvu PPRA kutoa maelekezo kwa Mamlaka zinazohusika na ununuzi, (yaani Procuring Entities) kuchukua hatua kwa watakaokiuka Sheria ya Manunuzi ya Umma.




(iii) Kuifanya PPRA kuwa Taasisi Huru inayojitegemea ikiwa na Muundo sawa na ule wa Mkaguzi na Mdhibiti Mkuu wa Serikali (CAG).



(iv) Kufanya marekebisho yatakayowezesha Sheria kutoa adhabu kali kwa Viongozi na Watumishi wa Umma watakaobainika kujihusisha na ukiukwaji wa Sheria na Kanuni za Manunuzi ya Umma.



(v) Kufanya marekebisho ya kuzitaka Mamlaka zenye dhamana zitakazopokea hoja za ukiukwaji wa Sheria ya Manunuzi ya Umma kutoka PPRA, kutoa taarifa kuhusu hoja hizo katika kipindi maalum, na ikibidi kuchukua hatua zaidi kwa Taasisi au Mtu atakayekiuka Sheria na Kanuni za Manunuzi ya Umma.



(vi) Kuweka utaratibu mzuri wa namna ya kushughulikia masuala ya Ununuzi wa Dharura yanapotokea.



(vii) Kuweka utaratibu wa kuwezesha kufanyika uchunguzi wa kina (due deligence) kwa Wazabuni wa ndani na nje ya Nchi wanaoomba kuingia Mikataba na Serikali.



(viii) Kuweka Utaratibu wa kutumia Kamati Huru ya Wataalam itakayofanya uchunguzi wa kina pale itakapobidi.




AZIMIO NAMBA 2:

“Mamlaka ya Udhibiti wa Ununuzi wa Umma (PPRA) isiwajibike Wizara ya Fedha ambayo nayo ni Taasisi ya Ununuzi (Procuring Entity) badala yake iwe chombo huru kinachowajibika Ofisi ya Rais na Taarifa zake kuwasilishwa Bungeni.”


HATUA ZILIZOCHUKULIWA:

(i) Kulingana na Sheria ilivyo hivi sasa, PPRA ni Taasisi Huru inayojitegemea nje ya Muundo wa Wizara ya Fedha na Uchumi. Aidha, PPRA ina Bajeti yake inayojitegemea na pia ina Chombo chake Maalum cha Usimamizi, (yaani Bodi ya Wakurugenzi). Hata hivyo, katika Marekebisho ya Sheria yanayotarajiwa kufanyika, Serikali inakusudia kuwasilisha pendekezo la kufanya PPRA iwe na Muundo sawa na ule wa Mdhibiti na Mkaguzi Mkuu wa Hesabu za Serikali, (CAG) ambapo utatoa uhuru kwa Chombo hicho kutoa maamuzi ya kila siku bila kuingiliwa na Chombo chochote, ingawa Kisera itaendelea kuwa chini ya usimamizi wa HAZINA kama ilivyo kwa Mdhibiti na Mkaguzi Mkuu wa Hesabu za Serikali.

(ii) Kuhusu Taarifa za mwaka za PPRA kuwasilishwa Bungeni, suala hili limezingatiwa katika Kifungu cha 26 (2) cha Sheria ya Manunuzi ya Umma ya mwaka 2004, inayotumika hivi sasa. Chini ya Sheria hiyo, Waziri wa Fedha na Uchumi huwasilisha Bungeni Taarifa ya kila mwaka ya utendaji wa PPRA.

AZIMIO NAMBA 3:

“Mikataba kati ya TANESCO na Richmond Development Company LLC (uliyorithiwa Dowans Holdings S.A) na ile kati ya TANESCO na IPTL, SONGAS, AGGREKO na Alstom Power Rentals ipitiwe upya mapema iwezekanavyo kama ambavyo Mikataba ya Madini ilivyopitiwa upya na Serikali. Bila kufanya hivyo, mzigo mkubwa wa gharama za umeme utawaelemea Wananchi na kushindwa kufikia azma ya Serikali ya maisha bora kwa kila Mtanzania”


(ii) Mkataba baina ya TANESCO na RICHMOND (uliorithiwa na DOWANS)


Kutokana na utata uliojitokeza katika mchakato mzima kuhusu Mkataba baina ya TANESCO na RICHMOND uliotiwa saini tarehe 23 Juni 2006, Serikali kupitia TANESCO iliamua kufanyike mapitio ya Mkataba huo na


kupata ushauri wa kitaalam kutoka kwa Wanasheria waliobobea katika masuala ya Mikataba ya Kimataifa wa Kampuni ya REX ATTORNEYS. Uchunguzi wa REX ATTORNEYS ulibaini pamoja na mambo mengine kwamba:-

(a) Utaratibu mzima wa manunuzi ya huduma ya umeme na kuingia Mkataba na Richmond Development Company LLC ulikiuka Sheria ya Manunuzi ya Umma ya mwaka 2004;

AZIMIO NAMB 5:
“Kwa kuwa mkataba kati ya Tanesco na Richmond Development Company LLS (Sasa Dowans Holding S.A) umesheheni makosa mengi ya kisheria yanayoashiria udhaifu mkubwa wa kitaalam katika ofisi ya mwanasheria mkuu wa Serikali au ukosefu wa umakini katika kuiwakilisha serikali; Mwanasheria Mkuu wa Serikali na wakili wa serikali Donald Chidowu ambaye ushiriki wake katika GNT haukuwa na tija yoyote, wawajibishwe na mamlaka juu ya nchi kwa kuchangia kuiingiza nchi katika mkataba wa aibu.”


HATUA ZILIZOCHUKULIWA:
I) Kikatiba Mwanasheria Mkuu wa Serikali ndiye mshauri mkuu wa Serikali katika masuala yote ya sheria za nchi. Hivyo ana wajibu mkubwa wa kuishauri serikali katika maeneo ambayo anaona yanakiuka Sheria, taratibu na kanuni za nchi.

:angry::angry:Kutokana na nafasi yake kikatiba, mamlaka yake ya nidhamu ni mheshimiwa Rais wa jamhuri ya Muungano wa Tanzania. Kwa hiyo mwanasheria mkuu wa Serikali ambaye alikuwa miongoni mwa watendaji wakuu watatu waliokuwa wanaishauri Serikali suala lake la kuhusishwa kwake katika mchakato mzima wa mkataba hao linashughulikiwa na ofisi ya Rais Ikulu:angry::angry:

Kuhusu Wakili wa Serikali Donald Chidowu ambaye aliukwa ni miongoni mwa wajumbe wa kamati ya majadiliano (GNT) akimwakilisha mwanasheria mkuu wa Serikali, amepelekwa barua ya kutakiwa ajieleze kwa kuzingatia misingi ya kanuni asilia ya haki ya kusikilizwa kwanza (natural justice) na kuzingatia Sheria za Utumishi wa umma.

Mtumishi huyu amewasilisha utetezi wake kwa Katibu Mkuu wa Wizara ya Sheria ya sheria na katiba ambaye ndiye Mamlaka yake ya nidhamu katika muda wa siku 14 zilizotakiwa. Hivi sasa maelezo ya utetezi wake yanafanyiwa uchambuzi wa mamlaka yake ya nidhamu ili hatimaye maamuzi yatolewe kwa kuzingatia sheria, kanuni na taratibu za utumishi wa umma.:angry:

AZIMIO NAMBA 7:

“Wajumbe wote wa Kamati ya Serikali ya Majadiliano (Government Negotiation Team – GNT) ambao ni Maofisa Waandamizi wa Serikali wawajibishwe kwa manufaa ya Umma kwa kulitia hasara Taifa kutokana na kushindwa kutumia elimu na ujuzi wao kulinda maslahi ya Taifa”.

HATUA ZILIZOCHUKULIWA:

Katika kushughulikia suala hili, (yaani katika mchakato mzima wa Zabuni pamoja na majadiliano ya Mkataba baina ya TANESCO na RICHMOND), kulikuwa na Kamati za aina tatu.



Kwa madhumuni ya utekelezaji wa Azimio hili, Wajumbe wote wa Kamati hizi tatu wamepelekewa barua za kutakiwa watoe maelezo kwa mujibu wa Sheria zinazohusu nidhamu katika Utumishi wao. Hatua hii inazingatia Misingi ya Kanuni Asilia ya Haki ya Kusikilizwa Kwanza (Natural Justice), kabla ya hatua nyingine kuchukuliwa.

Miongoni mwa maeneo ambayo Watumishi hawa wametakiwa kutoa maelezo ni jinsi walivyohusika katika mchakato mzima na kuiingiza Serikali katika Mkataba unaoonekana kutokuwa na Maslahi kwa Taifa. Maeneo hayo ni pamoja na:

(i) Kutotumia utaalam na uzoefu wao kikamilifu ili kutambua mapema kuwa Richmond Development Company LLC haikuwa na uwezo kitaalam, kifedha na kiuzoefu na hivyo kutokidhi matakwa ya Zabuni.

(ii) Kutozingatia kikamilifu Sheria ya Manunuzi ya Umma, ya mwaka 2004 katika mchakato mzima wa kutoa Zabuni hii.

(iii) Wajumbe kushindwa kuishauri Serikali kuhusu kuifanyia Kampuni ya Richmond Development Company LLC uchunguzi wa awali (due diligence) pamoja na ukaguzi baada ya tathmini ya Zabuni (post qualification);

(iv) Kutokuwa makini na hivyo kushindwa kutambua udanganyifu wa ubia/uhusiano wa kibiashara kati ya Richmond Development Company LLC na Kampuni ya Kimataifa ya Pratt & Whitney;



Watumishi wote wameshawasilisha utetezi wao katika muda wa siku kumi na nne zilizopangwa. Aidha, hivi sasa utetezi wao unafanyiwa uchambuzi wa kina na Mamlaka zao za nidhamu ili hatua muafaka zichukuliwe kwa mujibu wa Sheria, Kanuni na Taratibu zinazotawala utumishi wao.

Kwa upande wa Watumishi wa TANESCO ambao ni Bw. Stephen Mabada, Bw. Athanas Mbawala, Bw. James Mwalilimo, Bw. Godson Makia na Bw. Mwita Wangwe, Kamati Ndogo ya Nidhamu ya Bodi ya TANESCO tayari imekwishapitia maelezo ya Watumishi wao wote na mapendekezo ya Kamati hiyo yamewasilishwa kwenye Bodi ya Wakurugenzi ya TANESCO ambayo itatoa maamuzi yake na kuiarifu Serikali

AZIMIO NAMBA 8:

“Waziri wa Nishati na Madini, Mhe. Nazir Karamagi (Mb.), aliyeshabikia sana uhaulishaji wa Mkataba kutoka kwa Richmond Develeopment Company LLC kwenda kwa Dowans Holdings S.A. awajibishwe”


HATUA ZILIZOCHUKULIWA:

Mheshimiwa Nazir Karamagi (Mb.), aliyekuwa Waziri wa Nishati na Madini alijiuzulu mwezi Februari 2008 kwa kuwajibika kutokana na suala hili. Hata hivyo, kwa lengo la Serikali kujiridhisha kuhusu ushiriki na ushauri wake katika suala hili,


Vyombo vya Dola vinaendelea na uchunguzi wa kina kwa lengo la kutaka kujua kama kuna rushwa yoyote ambayo ilijitokeza katika mchakato huu inayomhusisha Mheshimiwa Nazir Karamagi (Mb.), katika suala hili. Taarifa ya uchunguzi huo itawezesha Serikali kuamua juu ya hatua zaidi zinazostahili kuchukuliwa dhidi yake.

AZIMIO NAMBA 9:

“Mkurugenzi Mkuu wa TAKUKURU awajibishwe kwa manufaa ya Umma na Maofisa wa TAKUKURU walioshiriki katika zoezi la uchunguzi na kuandaa Taarifa ya Richmond Development Company LLC iliyoficha ukweli nao pia wawajibishwe kwa manufaa ya Umma.”



HATUA ZILIZOCHUKULIWA:

Zoezi la kufanya uchunguzi lililofanywa na TAKUKURU lilihusisha Watumishi wafuatao:



(i) Mkurugenzi Mkuu wa TAKUKURU, Bw. Edward Hosea akiwa ndiye Msimamizi Mkuu wa Taasisi ya Kuzuia na Kupambana na Rushwa (TAKUKURU), iliyohusika na uchunguzi wa mchakato mzima wa Zabuni ya umeme wa dharura, ulioipa ushindi Kampuni ya Richmond Development Company LLC.

(ii) Mkurugenzi wa Upelelezi Bw. Alex Mfungo ambaye ndiye aliyesimamia zoezi zima la uchunguzi na kuandaa Ripoti ya Uchunguzi ya TAKUKURU kuhusu suala hili.


(iii) Maofisa wanane wa TAKUKURU walioshiriki katika zoezi la uchunguzi na kuandaa Taarifa katika maeneo yao ya utaalam katika mchakato mzima wa Zabuni ya Ununuzi wa mitambo ya umeme wa dharura ulioipa ushindi Kampuni ya Richmond Develeopment Company LLC.


Ili kutekeleza Azimio hili, Mkurugenzi Mkuu wa TAKUKURU amepelekewa barua ya kutakiwa kujieleza na Mamlaka yake ya Nidhamu ambaye ni Katibu Mkuu Kiongozi. Vilevile, Wasaidizi walio chini yake walioshiriki katika zoezi la uchunguzi, nao wametakiwa kutoa maelezo yao kwa Mkurugenzi Mkuu wa TAKUKURU ambaye ndiye Mamlaka yao ya Nidhamu. Hii ni kwa kuzingatia Misingi ile ile ya Kanuni Asilia ya Haki ya Kusikilizwa Kwanza (Natural Justice).

Hata hivyo, kwa kuzingatia mazingira ya shauri hili, Katibu Mkuu Kiongozi ataamua juu ya utaratibu mzuri wa hatua za nidhamu dhidi ya Wasaidizi wote wa Mkurugenzi Mkuu wa TAKUKURU waliohusika katika suala hili.

Baadhi ya maeneo ambayo Mkurugenzi Mkuu na Wasaidizi wake wamepelekewa barua wajieleze ni yafuatayo:
(i) Kushindwa kuona kuwa Taarifa ya Uchunguzi iliyofanywa na Wataalam wa Taasisi yake haikubainisha kuwepo kwa kasoro nyingi zilizokuwepo katika Zabuni hiyo kama zilivyoainishwa katika Taarifa ya Kamati Teule ya Bunge, badala yake Taasisi iliona kwamba:-



§ Mchakato mzima ulizingatia Sheria, Kanuni na Taratibu za Serikali;



§ Hayakuwepo mapungufu makubwa katika Zabuni hii;



§ Hakukuwa na hasara kwa Taifa kutokana na Zabuni hii.



(ii) Kushindwa kuona kuwa ushauri uliotolewa na PPRA kwa TANESCO kuhusu muda wa kutangaza Zabuni Kimataifa ulipuuzwa na hivyo kuvunjwa kwa Taratibu za Sheria ya Manunuzi ya mwaka 2004, na hivyo kutia shaka.


Hivi sasa, Watumishi wote tisa wameshawasilisha utetezi wao katika muda uliopangwa. Aidha, kwa kuzingatia Sheria, Kanuni na Utaratibu wa Utumishi wa Umma, Mamlaka yao ya Nidhamu inapitia utetezi wao ili kutoa uamuzi unaostahili….


AZIMIO NAMBA 14:

“Waziri wa Nishati na Madini, Dkt. Ibrahim Msabaha (Mb.), na Katibu Mkuu, Ndugu Arthur Mwakapugi wachukuliwe hatua kali za kinidhamu kwa kuliingiza Taifa kwa makusudi kwenye Mkataba wa Kampuni ya Mfukoni. Aidha, Kamishna wa Nishati, Ndugu Bashir Mrindoko naye achukuliwe hatua za kinidhamu kwa kushindwa kumshauri Katibu Mkuu wake mpya kuhusu udhaifu wa Richmond Development Company LLC ambao ulijulikana dhahiri na Wizara mwaka 2004 kwenye Mradi wa bomba la mafuta. Ndugu Mrindoko ndiye aliyeiandikia barua Kampuni hiyo kusitisha Mkataba wake na Serikali mwezi mmoja tu kabla ya mchakato wa Zabuni ya umeme wa dharura haujaanza.”





HATUA ZILIZOCHUKULIWA:

a) Mheshimiwa Dkt. Ibrahim Msabaha (Mb.), aliyekuwa Waziri wa Wizara ya Ushirikiano wa Afrika Mashariki alijiuzulu mwezi Februari 2008 kwa kuwajibika kutokana na suala hili. Hata hivyo, kwa lengo la Serikali kujiridhisha zaidi kuhusu ushiriki na ushauri wake katika suala hili,


Vyombo vya Dola vinaendelea kuendesha uchunguzi wa kina. Lengo ni kutaka kujua kama kuna rushwa yoyote inayomhusisha Mheshimiwa Dkt. Ibrahim Msabaha (Mb.), ambayo ilijitokeza katika mchakato huu, ili hatimaye uamuzi stahiki dhidi yake uweze kuchukuliwa.


b) Kuhusu Katibu Mkuu wa Wizara ya Nishati na Madini Bw. Arthur Mwakapugi ambaye alikuwa miongoni mwa Wajumbe watatu wa Kamati iliyoundwa na Makatibu Wakuu wa Fedha na Uchumi, Nishati na Madini pamoja na Mwanasheria Mkuu wa Serikali, naye amepelekewa barua ya kutakiwa ajieleze katika maeneo ambayo Kamati Teule ya Bunge ilibaini kuwa hakuyazingatia kwa maslahi ya Taifa. Hatua hii imechukuliwa kwa kuzingatia Sheria na Kanuni za Nidhamu katika Utumishi wa Umma na Misingi ya Kanuni Asilia ya Haki ya Kusikilizwa Kwanza (Natural Justice), kabla ya hatua nyingine kuchukuliwa.



Bwana Mwakapugi amekwishawasilisha maelezo yake kwa Katibu Mkuu Kiongozi ambaye ndiye Mamlaka yake ya Nidhamu katika muda uliotakiwa.

Baadhi ya maeneo ambayo Katibu Mkuu wa Wizara ya Nishati na Madini ametakiwa kujieleza ni yafuatayo:


(i) Kutozingatia maagizo ya Baraza la Mawaziri kuhusiana na suala la ununuzi wa mitambo ya umeme wa dharura.


(ii) Kutozingatia ushauri wa kitaalam uliotolewa na PPRA kuhusu kufuata Sheria ya Manunuzi ya Umma ya mwaka 2004 na Kanuni zake za mwaka 2005.



(iii) Kutoishauri Serikali ipasavyo kuhusu umuhimu wa kuifanyia uchunguzi zaidi Kampuni ya Richmond Development Company LLC ili kujiridhisha na uwezo wake kifedha, kiutendaji, kiutaalam na kiuzoefu ili kulinda maslahi ya Taifa.

Hivi sasa, Mamlaka yake ya Nidhamu ambaye ni Katibu Mkuu Kiongozi, inafanya uchambuzi wa maelezo yake aliyoyawasilisha ili hatimaye maamuzi yatolewe kwa kuzingatia Sheria, Kanuni na Taratibu za Utumishi wa Umma

c) Kwa upande wa Kamishna wa Nishati Bw. Bashir Mrindoko ingawa hayupo kwenye Kamati zote tatu zilizotajwa awali, Kamati Teule iliona kuwa, Bw. Mrindoko kwa kuzingatia nafasi yake kama Kamishna wa Nishati, naye achukuliwe hatua za nidhamu kwa kushindwa kumshauri Katibu Mkuu wake mpya kuhusu udhaifu wa Richmond Development Company LLC. Kwa kuzingatia Azimio hili la Kamati Teule, Bw. Mrindoko amepelekewa barua ya kutakiwa ajieleze kwa kuzingatia Misingi ya Kanuni Asilia ya Haki ya Kusikilizwa Kwanza (Natural Justice) na pia kulingana na Kanuni za Nidhamu katika Utumishi wa Umma.


Miongoni mwa maeneo ambayo Kamishna wa Nishati ametakiwa kujieleza ni kushindwa kutumia utaalam na uzoefu wake kumshauri ipasavyo Katibu Mkuu wake kuhusu uwezo wa Kampuni ya Richmond Development Company LLC. Hii ni kwa kuzingatia kuwa, Kamishna huyu ndiye aliyehusika kuandika barua ya kusitisha Mkataba uliosainiwa tarehe 30 Juni 2004 baina ya Wizara na Kampuni ya Richmond Development Company LLC wa ujenzi wa bomba la mafuta la km. 1,150 kutoka Dar es Salaam kwenda Mwanza, kutokana na Kampuni hiyo kukosa uwezo wa kifedha.

Bw. Mrindoko amewasilisha maelezo ya utetezi wake kwa Mamlaka yake ya Nidhamu katika muda wa siku kumi na nne uliotakiwa.


Hivi sasa, Mamlaka yake ya Nidhamu inayafanyia uchambuzi maelezo yake ili hatimaye maamuzi yatolewe kwa mujibu wa Taratibu, Kanuni na Sheria ya Utumishi wa Umma ya mwaka2002.



AZIMIO NAMBA 15:

“Utaratibu wa kuteua Wakurugenzi na Makamishna katika Wizara kuwa Wajumbe wa Bodi za Wakurugenzi wa Mashirika yaliyo chini ya Wizara zao unazua mgongano wa kimaslahi na kudhoofisha usimamizi pamoja na uwajibikaji, hivyo Serikali iupige marufuku mara moja.”


HATUA ZILIZOCHUKULIWA:

Ni kweli kuwa huenda katika baadhi ya maeneo, mfumo huu wa uteuzi wa Wakurugenzi au Makamishna kuwa Wajumbe wa Bodi za Mashirika ya Umma unaweza kuwa na matatizo. Hata hivyo, baada ya Serikali kuzingatia Azimio hili, imeona pia kwamba, zipo pia faida za baadhi ya Wakurugenzi au Makamishna kuwa Wajumbe wa Bodi hasa katika kusaidia kutoa msimamo na ufafanuzi wa Sera na Mipango mbalimbali ya Serikali. Kwa kuzingatia umuhimu huo, Serikali inaona ni vyema utaratibu huo uendelee lakini kila Bodi itaangaliwa kipekee. Pale itakapodhihirika kuwa ni kwa maslahi ya Taifa kuwateua baadhi ya Wakurugenzi au Makamishna kuwa Wajumbe katika baadhi ya Bodi, Serikali itafanya hivyo kwa maslahi ya Taifa letu.







AZIMIO NAMBA 17:

“Msajili wa Makampuni (BRELA) aifute Kampuni ya Richmond Development Company (T) Ltd. mara moja kutoka kwenye orodha ya Makampuni halali Nchini.”






HATUA ZILIZOCHUKULIWA:

Serikali imefanya uchunguzi juu ya Usajili wa Kampuni ya Richmond Development Company LLC pamoja na Richmond Development Company (T) Limited ili kubaini uhalali wake na kutaka kujiridhisha kama usajili wake uliofanywa na BRELA ulikuwa kinyume cha Sheria za Nchi. Uchunguzi huo umebaini yafuatayo:





(ii) Hakuna taarifa ndani ya BRELA zinazoonyesha kuwa, Richmond Development Company LLC iliyoshinda Zabuni husika, ilikasimu jukumu lake la kuzalisha umeme wa dharura kwa Richmond Development Company (T) Limited ambayo ndiyo ilisajiliwa Nchini kwa kusudio hilo.

(iii) Kutokana na utata huo uliojitokeza, Mwanasheria


Mkuu wa Serikali ametoa ushauri juu ya Mamlaka ya BRELA ya kuifuta Kampuni ya Richmond Development Company (T) Limited kwa kuzingatia Sheria ya Makampuni (Sura ya 212). Hivyo, kwa mujibu wa kifungu cha 215 cha Sheria hiyo, BRELA imekwishatoa notisi ya siku thelathini kwa Kampuni ya Richmond Development Company (T) Limited kuwasilisha utetezi wake kabla ya hatua za kuifuta kampuni hiyo kuchukuliwa. Taarifa hiyo ya notisi iliyotolewa na BRELA haijajibiwa.

HATUA ZILIZOCHUKULIWA:


Awali, Serikali ilimuagiza Mwanasheria Mkuu wa Serikali kupitia kwa makini Taarifa ya Kamati Teule ya Bunge; pamoja na kumbukumbu zote za Mjadala wa suala hili Bungeni, ili kubaini maeneo yenye Makosa ya Jinai ambayo yangewezesha Serikali kuwafungulia mashtaka Wamiliki wa Kampuni ya Richmond Development Company LLC na Richmond Development Company (T) Ltd na Wawakilishi wao.

(iii) Kwa kuwa Makosa ya Jinai hupelelezwa na Polisi, TAKUKURU, Mamlaka ya Mapato na Vyombo vingine ambavyo vimepewa Mamlaka hayo Kisheria, Serikali iagize Vyombo hivyo vya Dola vilivyopewa Mamlaka ya kufanya upelelezi na kukusanya ushahidi vifanye kazi hiyo. Hii ni kwa mujibu wa Sheria ya Mwenendo wa Mashtaka ya Jinai - (The Criminal Procedure Act Cap. 20 R.E. 2002);

Lengo la zoezi hili ni kujiridhisha na kupata ukweli na ushahidi wa kutosha unaoweza kupokelewa na kukubalika Mahakamani kwa kuzingatia masharti ya Sheria ya Ushahidi (The Evidence Act, Cap 6. R.E.2002).

Hivyo, hivi sasa Vyombo vya Dola ikiwemo Idara ya Polisi vimepewa kazi hiyo na vinaendelea kufanya upelelezi na uchunguzi wa kina wa nyaraka na hati mbalimbali zilizowasilishwa na Wahusika kabla ya kuchukua hatua nyingine dhidi ya Wamiliki wa Kampuni ya Richmond Development Company LLC na Richmond Development Company (T) Ltd na Wawakilishi wao kwa kuzingatia Sheria, Kanuni na Taratibu zilizopo.

AZIMIO NAMBA 20:

“Serikali iendeshe uchunguzi maalum ili kubaini ukweli kama Taarifa rasmi ya TAKUKURU iliyotoa matokeo ya uchunguzi kuhusu mchakato wa Richmond ilikataliwa na kuharibiwa na kutolewa nyingine na kama jalada halisi linalohusu Kampuni ya Richmond lililokuwa BRELA liliharibiwa na kuwekwa lingine kwa lengo la kuficha ukweli”

HATUA ZILIZOCHUKULIWA:

Wizara ya Mambo ya Ndani ya Nchi kwa kushirikiana na Vyombo vingine vya Dola wanaendelea na uchunguzi wa kina kuhusu suala hili.

HATUA ZA NIDHAMU KWA WATUMISHI:

7. Mheshimiwa Spika, kabla ya kumalizia naomba kutoa angalizo kwamba, katika kushughulikia suala hili, Kamati Teule ya Bunge katika baadhi ya Maazimio yake yanayohusiana na kuwachukulia hatua za kinidhamu baadhi ya Watumishi wa Umma waliohusika katika mchakato mzima wa Mkataba baina ya TANESCO na RICHMOND, imetumia maneno mbalimbali kama ifuatavyo:

Azimio Namba 5:

“………wawajibishwe na Mamlaka ya juu ya Nchi kwa kuchangia kuiingiza Nchi katika Mkataba wa aibu.”

Azimio Namba 7:

“……Maofisa Waandamizi wa Serikali wawajibishwe kwa manufaa ya Umma…..”.


Azimio Namba 9:

“…….wawajibishwe kwa manufaa ya Umma.”

Azimio Namba 14:

“……. wachukuliwe hatua kali za kinidhamu kwa kuliingiza Taifa kwa makusudi kwenye Mkataba wa Kampuni ya Mfukoni”.

8. Mheshimiwa Spika, Katika kutafsiri maana ya maelekezo haya, Serikali imeona kwamba, yanaweza

kuwa na maana ya kushtakiwa Mahakamani kwa Makosa ya Jinai; ama kutumia Mamlaka ya Rais ya kuwastaafisha kwa manufaa ya Umma; ama kuchukua hatua za kinidhamu kwa mujibu wa Sheria ya Utumishi wa Umma na Kanuni zake.


Serikali baada ya kutafakari kwa kina suala hili, imeona kuwa, katika mazingira ya suala hili, ni busara kutumia utaratibu wa hatua za mashtaka ya Nidhamu chini ya Sheria ya Utumishi wa Umma. Utaratibu huu ni mwepesi na unaweza kusimamiwa kwa haraka zaidi, lakini bila ya kuathiri Misingi ya Haki Asilia (Natural Justice) ya Mtu Kupewa Haki ya Kusikilizwa Kwanza. Hii ni hatua muhimu sana kwani hata chini ya Mamlaka ya Rais ya kumstaafisha Mtumishi kwa manufaa ya Umma, taratibu zinataka Mtumishi apewe fursa ya kutoa maelezo ya kujitetea kabla ya hatua yoyote kuchukuliwa. Hii inatuondolea hatari ya Serikali kushtakiwa kwa kutofuata Sheria, Kanuni na Taratibu kama ilivyowahi kutokea huko nyuma, ambapo baadhi ya Viongozi na Watendaji walistaafishwa kwa manufaa ya Umma kimakosa, na baadaye Serikali ikalazimika kuingia gharama kubwa ya kuwalipa fidia. Vilevile, hatua hii inaipa nafasi Serikali kupitia utetezi utakaotolewa kuona ni Watumishi gani wanaoweza kustahili kushtakiwa kwa Makosa ya Jinai kwa mujibu wa Sheria za Nchi.

Hii taarifa ya Waziri Mkuu Pinda inaonyesha jinsi gani ilivyo ngumu kwa Serikali kuwashughulikia hao waoanaoitwa watumishi wa "umma " wanapovurunda au "kupinda!!!!

Hivi unapotaka Mwanasheria Mkuu wa Serikali ambaye anatuhumiwa kuhusika kwenye kashfa na maafisa wakuu wa ofisi yake atoe ushauri wa hatua za kisheria za kuchukuliwa, au Naibu wake (Katibu Mkuu wa Wizara ya Sheria amchukulie hatua za nidhamu Mtumishi anayetuhumiwa kwa kashfa inayomhusu pia Bosi wake (AG), unatarajia matokeo yake ni nini kama si danganya toto???

au Unapomtaka Mkurugenzi Mkuu wa TAKUKURU achunguze kama kuna rushwa au lah kwenye sakata linalomhusu, jawabu lake ni nini??

au Unapoitaka Mamlaka ya nidhamu kama Mkurugenzi wa TAKUKURU wamwajibishe afisa aliye chini yake kwa kosa la uzembe kazini wakati nae anahusika katika kosa hilo hilo matokeo yake ni nini?

Iwapo Mamlaka ya nidhamu ya Mwanasheria Mkuu wa Serikali yapo chini ya Rais, na iwapo Kikatiba Manasheria Mkuu ndie mshauri wa Serikali wa masuala yote ya Kisheria...na Mwanasheria huyo Mkuu shtaka lake ndilo lipo mbele ya Mhe. Rais wakati mtuhumiwa bado yupo madarakani na amepewa majukumu mengine ya kushughulikia kuhusu suala hilo hilo, hivi kuna kesi hapo???.

Au unamtaka Rais au Katibu Mkuu Kiongozi mwajibishe Katibu Mkuu wa Wizara ya au Idara ya Serikali yake au anayetuhumiwa kwa kukiuka Sheria na taratibu, wakati mfumo wa utendaji Serikali unaanzia katika ofisi ya huyo Katibu Mkuu kiongozi, na wakati huo huo pengine Katibu Mkuu kiongozi anaweza pia kuomba ushauri kwa Mawanasheria Mkuu wa Serikali ambaye nae anatuhumiwa kwa kashfa hiyo hiyo, Je, hatima ya mashtaka ya jinsi hii ni nini kama si kusameheana na kugongeana glasi za mvinyo.?...

THE Kisutu Resident Magistrate's Court in Dar es Salaam ordered the prosecution today to expedite the investigation into a fraud case against the Managing Director of Richmond Development Company, Naeem Adam Gire.

Principal Resident Magistrate Wariarwandwe Lema ordered that on April 21, when the case will be mentioned, the prosecution should come up with a tangible answer on the status of the investigations.

She was reacting to a concern by advocate Kato Zanke (for the accused), on an 'endless song' by the prosecution of seeking further adjournments of the case on claims that investigations into the case were still incomplete.

Advocate Zanke also complained that for several occasions the prosecution came to court without the case file. He pointed out that coming without a file was akin to a lack of representation for the prosecution.

Earlier on, State Attorney Beatrice Mpangala, had told the magistrate that the prosecution was seeking further adjournment of the case because investigators were still collecting more evidence against the accused.

She further informed the court that she did not have the police case file with her. Therefore, she requested for an adjournment to give her time to make a follow-up on the matter. However, the court granted the adjournment.

Naeem appeared before the court on January 13, last year, facing five counts of forgery, uttering false documents and giving false information on the capacity of Richmond Development Company to produce 100MW of electricity in Tanzania.

On March 13, 2006 in the city, with intent to defraud, Naeem allegedly forged a Power of Attorney, purportedly showing it was signed by Mohamed Gire, the Chairman of Richmond Development Company LLC of Texas, in the US.

The Power of Attorney authorized Naeem to carry on the business of the company in Tanzania. On March 20, 2006, knowingly and fraudulently, he allegedly uttered the document at Umeme Park Ubungo, along Morogoro Road.

On the same day at Umeme Park Ubungo, the accused gave information to members of the Tanzania Electric Supply Company (Tanesco) Tender Board, persons employed in the public service, while knowing the same was false.

Such false information allegedly showed that Richmond Company of Texas America was capable of producing 100MW and intended to cause members of the board to recommend selection of the company.

The prosecution alleged further that in June 2006, Naeem also gave similar information to members of the Government Negotiating Team, persons employed in the public services, for same purposes.

Finally, Richmond Company was awarded the tender and signed a contract of generating electricity. However, it was proved latter that the company had no such capacity as claimed and failed to undertake the assignment.

In February last year, the Parliamentary Select Committee, led by Kyela Member of Parliament Dr Harrison Mwakyembe, which conducted an inquiry into the Richmond scandal, released its report and called for resignation of all top government officials implicated in the controversial contract.

Prime Minister Edward Lowassa, who was mentioned in the report, decided to resign. He was followed by Mr Nazir Karamagi and Dr Ibrahim Msabaha, the then Ministers of Energy and Minerals and Minister for East African Cooperation, respectively, who were also mentioned in the report.

Najua nini kitafuatia baada ya sakata hili la nishati kati ya Richmond Development Company, Tanesco na Serikali:

a. Serikali/Tanesco itavunja mkataba na RDC
b. Serikali itasema haikuridhishwa na utendaji wa kampuni hiyo.
c. Serikali inafanya juhudi zaidi na makampuni mengine kusaidia kuondoa adha ya kukosa umeme.
d. Waliohusika na mkataba wa RDC na Tanesco, na Wizara wataendelea kutembea vifua mbele bila hatua za kinidhamu dhidi yao kuchukuliwa.
e. Watanzania watapiga makofi, na kumpongeza Kikwete kwa "Kazi nzuri"
f. Watanzania watasahau ya mkataba huu, hadi mwingine utokee tena, na gurudumu la upotovu litaendelea kubingirika!!

Ila kabla ya hayo kutokea sikiliza ukweli kuhusu kampuni hii ni nini?

Mkuu MM, hebu soma hitimisho katika taarifa ya Waziri Mkuu yapata miaka mitatu iliyopita kisha soma ile taarifa ya Ikulu iliyotolewa na JK kupitia Luhango kuhusu hatua dhidi ya waliohusika,utaona jinsi gani watanzania tulivyohadaiwa kwenye hili sakata. Haiwezekani kabisa Serikali ikasema tunapaswa kulipa deni lililosababishwa na uzembe wa makusudi wa watendaji wake ilihali watendaji hao wamefunikwa na kupewa kinga za kisheria tena wengine kama akina Johnson Mwanyika wamekwishastaafu kwa heshima.
 
Na bado wanazidi kuchakachua mambo;hivi tangu lini mambo ya msingi yakapuuzwa halafu yasiyokuwa ya msingi wanayanyalia bango mpaka mwisho wake ujulikane.

Hapa ndipo utakapojua uongozi wa nchi hii kwa muda mrefu ni kichwa cha mwendawazimu.
