Serikali ya Peru imetangaza kupitisha Sheria kuwa Watu waliobadili jinsia kuwa wana changamoto ya Ugonjwa wa Akili na kuwa wanastahiki Huduma za Afya ya Akili.

Shirika la Kutetea Haki za Binaadamu la Human Rights Watch (HRW) limekosoa uamuzi huo wa Serikali na kueleza kuwa haioni kama watu wenye mlengo huo wana changamoto hiyo ya akili.

Mwaka 2014, Luisa Revilla alikuwa Mtu wa kwanza aliyebadili jinsia kuchaguliwa Nchini Peru aliposhinda kiti cha Baraza la Mtaa, aliondoka ofisini Mwaka 2019 na kufariki Dunia kwa Ugonjwa wa UVIKO-19, Mwaka 2021.

Baada ya tamko hilo la Serikali, Waandamanaji zaidi ya 500 katika Mji Mkuu wa Peru wameandamana kupinga Sheria hiyo.

The Peruvian government on May 10 published a decree that classifies transgender people as mentally ill.

Human Rights Watch on Wednesday noted the country’s Essential Health Insurance Plan that President Dina Boluarte, Health Minister César Vásquez and Economic and Finance Minister José Arista signed references “ego-dystonic sexual orientation.” The decree also notes, among other things, “transsexualism” and “gender identity disorder in childhood.

Human Rights Watch in its press release notes the Health Ministry subsequently said it does not view LGBTQ identities as “illnesses.” Peruvian LGBTQ advocacy groups, however, have sharply criticized the decree.

“This decision is an alarming setback in our fight for the human rights of trans people in Peru, and it represents a serious danger to our health and well-being,” said Miluska Luzquiños, a trans activist who works with the Latin American and Caribbean Network of Trans People, which is known by the Spanish acronym REDLACTRANS, on her Facebook page.

A lack of legal recognition and protections has left trans Peruvians vulnerable to discrimination and violence.

Luisa Revilla in 2014 became the first trans person elected in Peru when she won a seat on the local council in La Esperanza, a city in the northwestern part of the country.

She left office in 2019. Revilla died from COVID-19 in 2021.

Peru protesters slam new insurance law that deems transgender people mentally ill

LIMA, May 17 (Reuters) - Hundreds of protesters in Peru's capital marched on Friday to demand the scrapping of a new law that describes transgender people, among others, as having a mental illness so they can access health benefits.

Around 500 demonstrators peacefully walked the streets of downtown Lima, hoisting banners with slogans that read "No more stigmas" and "My identity is not a disease."

The law, which was approved administratively last week by the government of President Dina Boluarte, specifies that those who identify as transgender, along with "cross dressers" and "others with gender identity disorders," are considered to be diagnosed with "illnesses" that are eligible for mental health services via both public and private providers.

The protesters reached the health ministry offices, but no clashes were reported.

"Gender identities are no longer considered pathologies," said activist Gahela Cari Contreras, who accused Boluarte's government of trying to trample on the LGBTQ+ community's rights. "We're not going to let them."

Critics of the law have argued that its update of the country's PEAS health regulations was unnecessary, since existing rules already allowed for universal access to mental health services.

Government officials have sought to chalk up the controversy as a misunderstanding.

In a statement released shortly after the law was promulgated, the health ministry insisted that it rejects the stigmatization of LGBTQ+ people and that the legal language simply seeks to ensure more complete health coverage.

The ministry "categorically reaffirms respect for the dignity of the person and their free actions within the framework of human rights, providing health services for their benefit," according to the statement.
